   An act to add Section 56839.5 to the Government Code, relating to
annexation.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 560, as introduced, Monteith.  Annexation to a city.
   Under existing law, the Cortese-Knox Local Government
Reorganization Act of 1985, the local agency formation commission in
each county has various powers relating to its duties to approve or
disapprove changes of organization and reorganizations of local
government agencies.
   This bill would provide that notwithstanding any other provisions
of law, the commission shall approve an annexation to a city after
notice and hearing and shall authorize the conducting authority to
order the annexation of territory without an election if the
territory meets certain requirements, including notice to prospective
purchasers of the city's right to annex the property without an
election.
   Vote:  majority.  Appropriation:  no.  Fiscal committee:  no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 56839.5 is added to the Government Code, to
read:
   56839.5.  Notwithstanding Section 56375, or any other provision of
this division or law, the commission shall approve the annexation to
a city after notice and hearing, and authorize the conducting
authority to order annexation of the territory without an election,
if the commission finds that the territory contained in an annexation
proposal meets all of the following requirements:
   (a) The city entered into an agreement with the owner of the
property to extend municipal services to the territory which is
contiguous to the city boundary and located within the city's sphere
of influence.
   (b) The property owner who develops the property has notified each
prospective purchaser, in a written form that is required to be
signed by the prospective purchasers, prior to the sale of any
residential or commercial site within the territory subject to the
agreement between the city and the property owner, of the city's
right pursuant to this section to annex the property at a future time
without an election.
   (c) The notification pursuant to subdivision (b) shall be recorded
along with the title of the property and shall run with the land, so
that all future purchasers or lienholders of the affected property
are advised of the city's right to annex the property without an
election.
